Pensaki collects, processes and utilizes personal details to the extent required for the utilization and invoicing (usage data) of the services provided by Pensaki.com.

A "user" is any individual or legal entity, which registers with Pensaki.com as consumer or as company and uses its services or purchases its products. Personal data constitute individual details of the personal and factual circumstances of a certain or specific or identifiable natural person. Personal data is individual information about personal and factual circumstances.

As defined by sections 5 and 6 of the German teleservice data protection act (TDDSG) we differentiate between master data or usage data.

  • Master data are those pieces of personal information captured and used for the justification of providing the services ordered by the customer. This set of personal data is mandatory for Pensaki's ability to fulfill the contractual obligations. The personal master data includes the registration and invoice data.

  • Usage data, according to section 15 paragraph 1 of the German teleservice data protection act (TDDSG), is personal information that relates to your usage of our website and services as well as to its subsequent billing process.


3. Master data

3.1 Registration

When registering with pensaki.com the following personal data are captured:

  • - registration data; email address and password

  • - Billing data: name of the company, contact name and postal address, VAT number.

The e-mail address is needed for all correspondence between Pensaki and the user in implementing the users' contract, as well as for transmitting information about other offers by Pensaki. The user may renounce these offers at any time. The renunciation has to be addressed to the contact mentioned below, or by clicking the respective link in the email.


3.2 User account

The user name for a user account consists of the email address of the user. Once the user has successfully registered for a user account Pensaki sends an e-mail with the activating link for his account. The user has to handle his password confidentially and for security reasons he should change it from time to time. To do so he has to visit the “my Pensaki” section. During login the users name and password are always https secured and securely transmitted. Pensaki stores only the encrypted password to make it impossible for other staff members of Pensaki to read it. No Pensaki staff member will ever ask the user to reveal his password. Should the user nevertheless receive such a request, it is most likely a phishing attack. In that case Pensaki asks you to inform us via security ( a t ) pensaki.com.

4. Usage data

During each visit of www.pensaki.com the necessary access data of the user on the server of Pensaki shall be stored in a protocol file for the use of this service and for billing purposes (log file). The following data are thus stored:

  • IP address of the computer which requests this page,

  • the web-site from where the user found the requested site;

  • date and hour of the request of this site;

  • name of requested website

  • amount of data sent;

  • information about the browser used


Storing the log file serves the following purposes:

  • ongoing optimization of Pensaki's services and user interfaces.

  • detection of illicit usage of any other form of improper usage, where there are factual indications or reasonable grounds for believing that this might be the case.

  • Technical protective measures (recognizing, limiting or eliminating malfunctions or errors on the website)


5. Newsletter

During registration the user may subscribe to the email Newsletter suggested on the site. This is done by marking the corresponding checkbox. The Newsletter will then be sent via email to the address, which the user has provided during registration. The newsletter may be cancelled at any time by following the corresponding link in the newsletter.



6. Usage of web analytics tool


6.1 Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”).  Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States .

We have activated the IP address anonymization, and therefore Google Analytics anonymizes the address as soon as technically feasible at the earliest possible stage of the collection network. The IP anonymization feature in Google Analytics sets the last octet of IPv4 user IP addresses and the last 80 bits of IPv6 addresses to zeros in memory shortly after being sent to the Google Analytics Collection Network. The full IP address is never written to disk in this case. In case you want to refuse as well the creation of user profiles via pseudonyms, you may object to such pseudonym user profiles at any time with immediate effect for the future. In addition, you have, at any time, the right to objection to advertising with effect for the future. In view of the discussion on the use of analysis tools with full IP-addresses, please note that this website uses Google Analytics with the extension/add-on "_anonymizeIp()" and that thus IP-addresses are processed only in an abbreviated form in order to rule out any direct relation to persons.


7. Browser setting

7.1 Cookies

While using pensaki.com so-called “cookies” are stored on the computer of the user. A cookie is a small text file in a list of files provided for this purpose in the computer. This file serves the identification of the user computer during the session in order to be able to work comfortably with Pensaki.com. Cookies cannot manipulate the computer of the user and can be erased at any time manually most simply in the browser. 8. Dissemination of personal data to third parties

Personal data is stored exclusively on computers and servers of Pensaki. Only Pensaki uses the data whereby authorized members of staff only can access them when necessary for the completion of the relevant tasks.
